  • Special consideration is often given to off duty police officers for the sake of security and police presence in the community. Even though the officer is technically off duty, the visability of a police vehicle in the community reduces crime.
  • Since we have very limited guest parking and the off-duty officers have driveways to park their vehicles they are being inconsiderate to their neighbors.
  • This is a tough question to answer. most police officers are on call 24-7 and must have their police vehicles readily available. the police may park their police vehicle on the public street for this reason. the public can park on the street, as long as neither is in violation of the law. i assume the visitor parking is on private property. this is a question that needs to be addressed by the hoa. there may be an agreement that the officer can park his police vehicle in this location. one of the main reasons the take home car program was initiated, was more presence of police vehicles to deter crime. and, it works. just check the stats. and, no matter if the officer is on or off-duty, if you need his assistance, he is close. just look for his off-duty police car. my neighbors love my police car parked in the neighborhood. they have expressed their appreciation and have offered their driveways to park my police car, if i need an extra parking space. public safety is always number one with the police.
  • When a police officer has ample parking space in his/her driveway and/or garage and uses one of the very limited guest spots this creates a problem for the rest of the homeowners. It is not a question of having room on his property to park, I believe it is just being too lazy to switch cars if he/she has to park one car behind another. I have three cars and do so all the time. I am on our BOD and know that several specific police officers have been repeatedly asked to refrain from doing this and ignore the request. The streets are private as are the visitor parking spaces. We have over 890 homes and probably thirty police offices living in our community. Only a handful are in violation. Because a home owner chooses to turn their garage into a second family room is their choice. If you have a two car garage and a two space driveway and three vehicles you don't use your garage for a game room and park you vehicle illegally. If they park their personal vehicle on the street or in a guest spot they would get it towed. You can't tow a police car and therefore they abuse the parking with the official vehicle. Many homeowner associations restrict or try to restrict commercial vehicles with writing on them (including police vehicles) from parking in the owners driveways. We are saying "PLEASE PARK YOUR POLICE CAR IN YOUR DRIVEWAY." Would a letter to the watch captain or chief of police help in getting these violators to quit abusing the common property and breaking association rules?

I am a police officer who takes home their marked police vehicle and I park it on the roadway between my and my neighbor's house. My neighbors have told me that they love it because it reduces the speeders that come through the neighborhood and is a good deterrent. My HOA doesn't see it that way though and are threatening fines if I don't move it. The streets are public, owned by the county... Even though my guild has mailed them a letter with relevant case law, the HOA's response was that they didn't find it compelling!! This is a legal battle they will lose. Just because Roe V Wade is old case law doesn't make it any less relevant!
