    An employer cannot legally fire a worker for taking time off under the FMLA (Family and Medical Leave Act). Part of the act includes a provision protecting employees by requiring employers to give them this unpaid time off. However, it is legal to fire an employee while on FMLA leave if it is for different reasons.

    It would be very difficult for the employer to defend, they would need to be very careful about the reason for dismissal they will almost certainly test you but settle out.
