You know, there shouldn't HAVE to be specific laws having to deal with texting while driving, or any of the other cr*p people do while driving.

People who get behind the wheel of a car are supposed to be in TOTAL CONTROL of several thousands of pounds of steel and plastic at ANY speed. (OK, three pounds, 7 1/2 ounces for those stupid Smart cars).

The consequences of losing control of such a vehicle may be pretty d*mn severe. That's why we have things like Drivers Education courses, driver's exams, and Drivers Licenses.

If people cannnot drive responsibly, take the priviledge away from them.

The same centre in the brain for judging spatial issues - vital when "reading the road" driving, are used by the speech centres.
Using a cellphone is a major distraction, and nobody who is serious about road safety would do it, hands free kit or not, unless it was an emergency.

In California it is illegal to use a cell phone that you need to hold in your hands. If you have earphones that's fine. Texting while driving is suicide or homicide. You either get killed or kill..at least that is the potential dark end of that road. Why people are so addicted to the toy I have no idea. Why they are willing to harm themselves or others because of that addiction I also don't know. I suppose it is analogous to being a drug addict, alcoholic or sex addict. You know better but are impotent to control yourself. Aaarrrggghhh! :( Happy Monday cbf! :)

Texting while driving, seemingly common sense, but definitely should be illegal especially if you live in a state like California where talking on your cell phone while driving is illegal.

It's illegal here In California, that was brought into law about two years ago, the only way you can talk on a cell phone while driving, is to use a handsfree set(blue-tooth) even that is still somewhat of distraction. I've known a few people who have got tickets for talking, or texting on there cell phones while driving, my brother being one of them, he was fined 150 dollars for it. Over all it's not worth it. Your at risk of hitting somebody, or getting into a accident.

I refuse to get into the car with one of my friend's who texts and drives. She has no idea what a bad driver she is because she doesn't ever see how close to crashing she gets because she's too busy texting. Then she gets mad at me when I grab the wheel to prevent us from crashing. "I've got this!" she yells, but I have saved us on more than one occasion.

Texting and driving is one of those things where you don't only put yourself at risk, but others as well. If it was only yourself that you were putting at risk, then let it be legal, but as long as others could die because of you, it should be illegal. Like having to wear a seatbelt shouldn't be a law, but it is here, which is stupid. But texting should definitely be illegal.

I live in Thailand. People texting and phoning while driving is the least of my worries on the road. Given how badly, recklessly, and often drunkenly Thais drive when they're supposedly paying attention, being distracted might actually make for a marked improvement: they at least would be less likely to be speeding, weaving through traffic, cutting people off, pulling out without looking, taking shortcuts through parking lots, drive-throughs, and sidewalks, cutting across 8 lanes in 100 feet to get to their exit, backing-up in the slow-lane for a mile or more to get to their turn-off, taking their hands off the wheel and eyes of the road to turn and Wai to every idol and temple along the road, and all the other crazy things they do.

But as to my answer ...

For texting? Only if the person is in an accident while doing so, and they are at fault. Texting should then be treated as contributory negligence.

Otherwise, where there is no victim there is no crime. All "laws" to the contrary are just a disguised and corrupt revenue generation scheme of petty tyrants.

For cell phones? No. That's stupid. You might as well make it illegal to listen to the radio or fiddle with the dial while driving, or to be having a conversation with a passenger. Also, if that's made illegal, then cops, truckers, and EMTs shouldn't be able to use the CB while driving either. (But if you're driving a stick, and aren't using a hands-free phone, AND you cause an accident while on the phone, then there should be additional legal and civil penalties.)

I believe it should be illegal. Multiple accidents are caused by texting drivers. I feel bad for any driver that hits me while texting (there will be pain) lol. =) Driving is not a need it is a want. Other people should not be put a risk because you are too vain and selfish to pull over and text or call while driving.

Nope. But once you crash you should be fully on the hook for all consequences.

There's two approaches... we can be very forgiving of accidents and try to pass laws against things that could lead to them. That's the approach we take now. Or we can not tell people how to drive, but expect them to live with the consequences if something happens.

The first approach has the downside that it puts the blame on specific things, not on people. A person caused the accident, the cell phone/booze/etc. didn't. Putting the blame on things means that a person who is licenced, sober, doing the limit, and not distracted by a cell phone is not at fault if they crash even if they have zero business being on the road.

If you caused an accident then you were doing something wrong, it doesn't matter if you were breaking any specific rules or not. If you never cause accidents then you're not doing anything wrong. Let's not cloud it up with BS to assist with govt revenue generation. Someone that crashes while texting is a bad driver, it's a simple as that, you can't fix that with laws.

Yes and Yes, and both are illegal here in Chicago. You can talk on your phone if you have an installed speaker in the vehicle, or if you use a bluetooth or other ear piece with microphone device. Both hands on the wheel and pay attention!

Yes, of course it should be illegal.
Text messaging while driving obviously increases your proneness to get into accidents. If it's an emergency, you would probably be making phone calls instead of text messaging. And if it's an emergency you can do something about, that is the only time cell phones should be allowed while driving; otherwise, pull off to the side of the road, or get a Bluetooth, and stop putting others at risk.

Yes it should. I'm 17 just recently got my permit and every time I get in the car I make sure my phone is on silent so I don't know if rings or if i get a text I just wait till i get to where I'm going then I check my phone.

I have several friends who just got their licenses who do the same thing but a few of them are dumb enough to think there so special that they can text and drive at the same time. Even my mom thinks she can text and drive but im working on breaking her of that habit.

Myth busters proved that driving and TALKING on the phone is equal to driving drunk and that's just talking. I can only imagine how much worse texting and driving can be.

Should be a divice to stop the texting while traveling. If your veh is moving no text messages will be accepted or sent.

I got my first cell phone and called my bussiness. Worker and friend of mine liked how it sounded. I told him that this could be the death of many people. Dialing the number was tough. I had been a police officer and had ot work the equipneot of the car, the radio and drive in high speed chase. I could do this with out problem. If i had to dial a phone or text, I doubt i would have made it. Some are more talented than I and I will give thme the credit for doign so. But to find out if you are this talented, it takes testing. In this testing life can be lost. Not just the person texting, but some person doing nothing but driving.

It is now, here. The law just started a few weeks ago. Teens are not allowed to talk and drive, in the city (ATL), you have to use a hands free. Texting is too distracting. I can't say I have never done it, but I do notice my driving changes. Now, I text at a stop if I absolutely need to. Other than that I just talk, if there is something I need to do. I would talk on my way home from work when I got off at 1 am to keep me awake. My best friend worked nights too, so that helped.

Certainly texting should be illegal. As for cell phones, I'm a little split only because some people have the ability to talk and drive, while many do not... it's like there should be a driving test to allow cell phone usage.

The real sad thing about texting related collisions is that people are dying for a technology that will probably be obsolete in the very near future.

Yes, texting and talking should be banned nationwide. People should ONLY be able to talk, if they had a true hands-free device. There is a ban in my area, but I travel to NC often and it's horrible there. You get people pulling out in traffic, talking away, holding their phones to their head, can't pay attention, causing an accident and all the way, they're oblivious to the damage they're causing around them, but most don't care in the first place. I say fine them to the max, make them pay until they're broke, and then some will wake up and stop talking or texting while driving, it's dangerous, especially for those of us who have to dodge those idiots while they're stuck in their own insignificant world.

If I send a text at a red light, where's the problem? I talk on the phone frequently when I drive and aside from an old lady running a stop sign and hitting me, I've been accident free since I was a teenager.

How's a guy(gal) supposed to get any work done if you take away so many hours from their day?

Definitely should be illegal to text while driving. It's plain idiotic. I find it hard to text and walk at the same time.

However, I do wonder about the talking on the cell phone and driving. Do people really get so into their conversations that it takes their concentration off the road? I don't get it. I talk and drive all the time. I'm just as aware of the road as when I'm not on the phone. I find it no different than if someone were physically in the car talking to me. I do not dial any numbers while driving, unless I'm stopped at a red light. I don't talk on the phone in parking lots or in heavy traffic.

The only kind of conversation I might see as a distraction is a heated argument. I don't really get into those. Not over the phone, anyway. I know some people do. And they'll do it anywhere (car, retail store, gas station) and they do it loud enough so that anyone within 50 feet knows about their unhappy marriage. I can see how it would be a distraction for these people if they were driving. I guess it should be illegal in order to protect us from them.
