In the state I live in, as long as a person who is 18+ is in the vehicle, a person with a permit may drive. If everyone was under 18 (or does not meet the requirements of who must be in the car when a driver with a permit is at the wheel), then it was illegal. However, if given a choice of letting a person with only a permit or somebody who is drunk drive. . .I would go with the driver with the permit any day. The best thing to do in that situation is either find another way home (bus, taxi) or call your parents to come get you, that way you aren't breaking the law or getting in a car with a bunch of drunks.
