Check your state statutes or local rules to determine when you may ask for a modification (the legal term used to amend a decree). Some states require that you wait a year or more absent a showing of an extreme change in circumstances. Statutes or rules can be found on court websites, at local libraries or at a law library.
File a motion to modify the decree. The motion must contain the names of the parties, cause number, date of original decree and briefly tell the judge what term(s) you are asking to modify and why you are seeking the modification. You must serve your ex-spouse with the motion.
Attend the hearing ordered by the judge. Present documentary evidence or witness testimony supporting your request for the modification. Your ex-spouse will be allowed to agree or object to the modification. The judge will then decide whether or not to grant the modification.
