Our landlord lives in another state and our lease states that the rent check must be postmarked no later than the 1st of the month. If the 1st falls on a Sunday, can we mail it on the next business day?

  • It depends on what your local laws are, but every place I have rented the 1st meant the 1st. Holiday, Sunday, . . .didn't matter. Better safe than sorry, you should probably send it on Saturday just to ensure the postmark is before or on the 1st.

Some landlords use this technique, if they want to get rid of a worthless renter. it may be a good technique. i would say that if you are a good tennant, create no problems, then your landlord will bend the rule for you. after all, your landlord does not want to have an empty apartment and his source of income, cut off. if i were a good tennant, i believe i would be one day late, just to see what happens. living in another state and being a landlord, makes for a tough time finding a tennant to replace you, living in another state. time, expenses, etc. add up. lets see what happens!
