Interviewers are legally not permitted to ask questions about nationality, marital status and family status, religion, age, sexual orientation, gender, residence, military service, criminal background, health and disability or religion.
When an interviewer asks an illegal question, he may either be unaware that the question is illegal, or may be testing your ability to think under pressure. The way that you react to an illegal interview question may be more important than your answer. Carefully consider the question and choose how to respond.
You may choose to honestly answer the question. Don't lie. Be aware that the information you provide in your answer may positively or negatively affect your chances of being hired.
In some cases, it may be appropriate to politely decline to answer the question. You may tell the interviewer that you don't believe the question is relevant to the position or that you simply don't feel comfortable answering it.
Try to determine the motive behind the question and give the interviewer the information she is really seeking. For example, if an interviewer asks, "Do you have any health problems," she may really be asking if you can handle the physical demands of the job.
