Penalties vary according to the seriousness of the intrusion, the hacker's record, whether financial harm was done, data was stolen or altered, IDs and/or passwords were stolen.
The decision to report hacking of e-mail depends on the damage. Is there perceived bodily threat? Is this 'stalking'? Is it simply being 'nosey'? The person making the complaint must be the judge of that. The intrusion is a crime; the action pursued is subjective.
