    Under laws in every state, a woman has the right to legally change her name back to her maiden name. This can be requested as part of a divorce action. It can also happen after the woman files a legal petition requesting a name change and completes certain simple requirements.

    On the Other: Some Circumstances Bar Name Changes

    In almost every state, it is not legal for a woman to change her name back to her maiden name if she is doing it in order to commit fraud. Additionally, in some states a criminal record can bar anyone, women included, from seeking a legal name change.

    Bottom Line

    Women almost always have the right to legally re-assume their maiden name, and the process to do this is not usually difficult. While it will be more difficult for women in some states who have criminal records, even in those cases an argument can be made for the name change as long as it's not being done for fraudulent purposes.

    There is a third, but more difficult way to revert to your maiden name, especially if you chose to do so after your divorce proceedings have been finalised.

    Generally, you will need to show government issued documents that clearly show the link between your married name and the name to which you want to revert. These documents could include your marriage licence issued by the Office of Vital Statistics (clearly showing the link between your married name and prior name) in conjunction with your birth certificate. If you have a passport or drivers licence in your prior name it will also add significant weight to your request.

    If you have sufficient documentation you may be able to have a U.S. passport issued in your prior name. You can then use this identification as supporting evidence of your name change with Social Security and the DMV. Once you have government issued identification in your new name you should find most other organizations willing to accept your name change.

    Of course you can. your maiden name is the one on your birth certificate so you can have all your personal documents put into your maiden name any time you like. taking a man's name on marriage is such a stupid custom anyway....why does it still exist in the 21st century?
