Under laws in every state, a woman has the right to legally change her name back to her maiden name. This can be requested as part of a divorce action. It can also happen after the woman files a legal petition requesting a name change and completes certain simple requirements.
In almost every state, it is not legal for a woman to change her name back to her maiden name if she is doing it in order to commit fraud. Additionally, in some states a criminal record can bar anyone, women included, from seeking a legal name change.
Women almost always have the right to legally re-assume their maiden name, and the process to do this is not usually difficult. While it will be more difficult for women in some states who have criminal records, even in those cases an argument can be made for the name change as long as it's not being done for fraudulent purposes.
