In Pennsylvania, DUI penalties are divided into three categories, depending on your blood alcohol concentration (BAC) at the time of arrest. The three levels are low penalty (0.08 to 0.099 BAC), high penalty (0.10 to 0.159) and highest penalty (0.16 and above). For the low penalty, consequences can include 6 months probation and a $300 fine, but your license will not be suspended or taken away.
If your blood alcohol concentration at the time of arrest is in the high or highest penalty levels, your jail time and fine cost increase. Also, your license will be suspended for up to 12 months (with the possibility for a Limited Occupational License after 60 days).
According to the Pennsylvania Department of Transportation, there is a tiered approach to DUI enforcement. This means that, while it is a possibility you could lose your license for your first DUI, it is not a certainty. The DUI laws in Pennsylvania are complex (and not limited to alcohol intoxication), so you will need to seek out a specialized lawyer.
