They cannot charge you for the merchandise unless it was damaged, or if you or your daughter are now in possession of it.

Why do you think that this wouldn't be legal? Why do you think that people should be permitted to steal as long as they pay for it when they get caught?
Its legal but not right. I mean they should give you a warning, not file crime charges. But how old is she thats a factor to this.
actually yes.because if she walked out with it and not paid for it then they will make you pay.also file criminal charges because stealing is a crime no matter how small it really is
how old is she...we are' legally' responsible , and responsible for restitution, for our children til certain age, usually 17,18...when they can 'legally' be tried as ADULTS....so, yeah, I think they can.....if she broke the neighbor window or car window out with a ball would you not make restitution ?
ps you said 'trying' to steal? so, she did not steal, just got caught...? in that case..no, they should not be able to charge you unless she broke or damaged it.....

Because there was no transfer of goods (assuming that the item was recovered by WalMart undamaged). If they take money, that means that there was no theft, and therefore no basis to press charges. If WalMart takes money for goods not delivered, they are guilty of theft. WalMart has no authority to fine anyone for real or attempted theft. They do have the right to compensation for damaged or unrecovered property. If, as I said, the property was returned or recovered undamaged, they have no right to ask for compensation because they have incurred no loss.

She was trying to steal merchandise, that means she was concieling an item, she should be charged for stealing, and Walmart calls the police when they catch someone concieling and attempting to leave the store.
