can a convicted level 3 sex offender have his charge of rape drop in level if time of conviction he was a minor of 15 but charges as 16?

• ok I understand what your saying, here is the facts, he was 15 could not read nore write at the time, he had no living parents or guardinings, he was told that he would 25 yrs and if he the plea he would do 4 and a half to 10, he did 13 over all. he always said he didn't di it and he wants to clear his name after all this time... he took the plea because he was afraid and didn't no any better. so should he try to clear his name, he was 15 and charged as 16.

• I see that I misunderstood the question. In order to overturn a conviction, he will have to have evidence that was not available at the time, such as DNA tests.
