Well last year on 4th feb 2009, i was at school, at the time i was 15 (turned 16 at the end of that month). basically i was on the top pitcch at lunch time, and this guy who had been bullyying me, randomly rugby tackled me (for no reaason but to hurt me). He seriously injured my knee in doing this (i think it was a dislocated kneecap in the end). i went to hospital, and i was on crutches for 2 weeks, couldnt do any sport for 3 months. i was also an active football referee at the time, and obviously because of his actions i couldnt do this, so i suffered loss of earnings of at least £250.
i think the key points are:
-he had been trying to hurt/humiliate me for quite a while
-it was unprovoked
-there was no need for it - we weren't playing rugby at the time or anything like that
-my knee still hurts now, and i can't put weight on it when i kneel down, nearly 13 months on
In the states you usually have 2 years to file a lawsuit. It also sounds like an intentional assault which could be prosecuted as a crime.
You've waited a long time to go about getting compensation. Events like these need to be done quickly and not a year after they take place. Did you report it to the school first? Did they take any action against him? Did you keep medical bills and x-rays that could be used in a civil case?
sue the parents, not the school , parents are responsible for their children and the damages at this age....you sue the school, taxpayers pay that debt....
