My wife who is divorced has a child that lives at home and she always claimed on taxes however because an old divorce decree he claims the boy now. if the boy is living with mom and dad is now claiming son,who gets the EIC?

I would interpret it as being able to claim him as a dependent for the tax year 2009. The return for that year would be filed in 2010.
