Help answer this question below.

Can you create your own lane next to a two lane street because the 2nd lane is wide?
I was making a left turn and the opposing 2 lane traffic had stopped for me, but I was struck by a car who was "curb" driving in the 2nd lane, he made his own 3rd lane.

    technically both your faults. how did you not see him unless the car closer to you was blocking your view? which in turn means you were trying to zoom out and make your left. fail to yield properly. his fault because he's a dumbass for not realizing people might come across like you did (and trying to pass illegally) both you guys are at fault.. but in the end it will be up to witnesses and your insurance companies. probably split somewhat down the middle.

    It depends on the laws of your town, county, and state.


    In Massachusetts it is legal to travel in the "breakdown" lane in some places at certain times.

    In NH, it doesn't seem to matter; the townies and the staties do it so I assume it's alright even if it's not legal.

    I don't think you are allowed to "curb drive" but also I think that if you are struck turning left it's your fault for not looking (even if you couldn't see). Seems like such a grey area. Also, I think who is at fault is decided by where the other person struck you - if you were hit in the front end of your car it's considered your fault because you shouldn't have turned, but if you are struck in the rear it's considered that other person's fault because they are considered having had enough time to stop from striking you. I would like to hear what your insurance company says and also what the police officer who came to the scene said.
