this should have been in writing...even if you got him to sign a hand written agreement....cannot trust anyone anymore......how old are the kids? most of the time a parent is so engrossed with theirself and what they want, they could care less what their kids want....especially if they are trying to get back at the other parent.....the kids are always the ones damaged.....hopefully he will humble and listen to his kids....unless you have the means financially to fight for their wellbeing......good luck.
Whomever has primary legal and physical custody can move wherever they want with the kids. They should take into consideration of the feelings of the child, but if they are moving for a job, or something that would better the family, even fighting it in court wouldn't work.
This sounds like dad has custody, but let the kids stay with mom? There is a reason dad was given custody over the mother. Was he still seeing the kids, while she had them? Was there a reason for them staying with her now and not before? The only thing would be to fight it in court.
If he didn't see them for the 2 years, mom could win, if he gave them to her to go to school or to better himself, that is a good thing for HIM. If he went to prison, good for HER. More details here, please.
Yes, if no official custody change was done. I see this happen a lot with fathers, usually right after filing to have child support stopped because he has possession of the kids. The mothers want the support, but not the kids.
