Help answer this question below.
S/he whose name is on the lease is on the hook for rent and damage. Your rights as a sublet unless landlord has fully signed off are negligible to nil. If landlord has fully signed off, you'll be entitled to stay until the end of the last month for which you've paid rent. Make sure you keep a receipt as evidence of payment in case roomie tries to throw her weight about.
If youlived there for more than thirty days, rent or no rent it is considered your dwelling and your roomate would have to evict you to force you out. Stay your two weeks because the cops will tell both of you to evict. The law is very clear that with or without lease or rent you live there and you must leave willingly or be evicted but you dont have to leave because they told you to.
A eviction is not thirty days written notice it is a legal process done through the court and your papers are hand delivered by a sheriff. A paper written by your roomate telling you to leave is not a legal document and holds no weight in court
It might depend on the state but also if you have paid rent through the next two weeks. If you have not paid rent for next two weeks and you do not have a lease I think she can ask you to get out.
It may vary from state to state, and depending on the exact circumstances, but in general to forcibly evict someone you must give 30 days written notice. If you are concerned, you can always consult with a lawyer who should be able to tell you your exact rights in this situation.
