    Each state has its own legal requirements governing who can be a registered agent in an LLC. Familial relationships do not prevent a person from being listing as a registered agent. Registered agents must live in the state that the business is located in, but your wife may be listed as one of the officers in the LLC.

    On the Other: Drawbacks of wife as the LLC registered agent

    A registered agent exists to be the legal representative of an organization. If a company is sued or there are any other legal problems, the registered agent will be contacted by the court or that state's department of corporations. Also, the registered agent is responsible for handling the annual renewal of the LLC's licenses. Should your wife not be qualified to handle such duties, it is not a good idea to put her down as the registered agent on the LLC.

    Bottom Line

    There is nothing legally barring you from appointing your wife the registered agent on the LLC. But your wife shouldn't serve in this capacity if she is not properly trained or is unable to deal with the legal ramifications should their be an issue with the business.
