just moved out of what i am sure is an illegal apt. and LL is not going to return security dep. do i have any legal recourse?

    That depends on your state, but generally, you have a lot of options. Most states have strict laws about the return of security deposits and if you pursue this legally, they can and will bring the hammer down on your LL. But you'll need to do your research first. There are non profit organizations out there that help in these disputes. Find your local one and contact them.

    More information is needed to answer your question. Every state has specific requirements that a LL must meet to keep your security deposit. However, the fact that the apartment was illegal is usually not grounds to get your deposit back.

    When a LL has an illegal apartment, you have the right to break the lease. If you break the lease, the LL cannot sue you for breach of contract. However, if you live in the apartment, the LL does have the right to collect any rent owed while you were living in the apartment.

    Similarly, if you damage the apartment, the LL has the right to compensated for the damages (which includes keeping the security deposit), even if the apartment is illegal.
