Abortion law varies from state to state. States can pass their own laws on abortion pertaining to presence of physicians, mandated education, parental involvement, public funding and partial birth abortions.
Minors
Minors seeking abortions in New Jersey do not need parental permission.
Presence of Physician
In New Jersey, the abortion must be performed by a licensed physician. The abortion must be performed in a hospital once the pregnancy reaches 14 weeks. A second physician does not need to be present.
Partial Birth Abortions
Partial birth abortions are legal in the state of New Jersey.
Funding
There is public funding for all or most medically necessary abortions. Private insurance coverage is not limited to life endangerment only.
Refusal to Participate
An individual provider may refuse to participate in the abortion. Also, private institutions are able to refuse participation.
Other Laws
Some states require mandatory counseling with information on psychological effects, fetal pain and a breast cancer link. These are not required in New Jersey. Also, there are states that prohibit abortions except in cases of life or health endangerment. However, New Jersey is not one of those states.
