The Texas eviction process is a legal procedure in which tenants lose their right to occupy a landlord's property. Landlords are allowed to use this process to evict tenants that have breached their lease agreement.
The Facts
Texas eviction laws require landlords to deliver a written notice to vacate, file suit with their county court, and prove their case before a judge in order to legally evict any tenant.
Time Frame
The eviction process can take up to 23 days to complete.
Written Notice to Vacate
A written notice to vacate can be posted on the property's front entrance, delivered to the tenant via certified mail or in person. It must specify how many days the tenant has to move out (at least three days unless the lease says otherwise.)
Filing an Eviction Suit
If the tenant fails to move out, the landlord must file a petition for eviction with the court in the county where the property is located.
Going to Court
The tenant is served with a citation to appear in court and each party is allowed to present their case. If the judge rules in favor of the landlord, the tenant has five days to move out or file an appeal.
