Various forms of both legal and physical custody of children are available when the parents' relationship is irrevocably broken. One of these options is to award full legal and physical custody of the children to one parent. When referring to the legal term "custody" with respect to children, there are two forms. Legal custody refers to decision-making authority on major issues in the children's lives. Physical custody refers to the residential arrangement for the children and the parents. If you have full legal custody, you have 100 percent of the individual decision-making responsibility for the children regarding all of life's circumstances. These include choices about education, religion, health care and child care. The other parent has no legal authority regarding such decisions. If you have full physical custody, the children reside with you 100 percent of the time. Both full legal and physical custody may not be awarded in a custody case. There are circumstances in which a family court may award one form of custody jointly, while the other form is awarded to one parent in full. Many situations exist that would prompt a family court to award full legal or full physical custody. Some of the most common ones involve parents who abandon parental responsibilities, situations involving domestic violence or child abuse, and people with diminished mental capacity.
