When referring to the legal term "custody" with respect to children, there are two forms. Legal custody refers to decision-making authority on major issues in the children's lives. Physical custody refers to the residential arrangement for the children and the parents.

Legal Custody

If you have full legal custody, you have 100 percent of the individual decision-making responsibility for the children regarding all of life's circumstances. These include choices about education, religion, health care and child care. The other parent has no legal authority regarding such decisions.

Physical Custody

If you have full physical custody, the children reside with you 100 percent of the time.
