  • The small claims court gives individuals and businesses a quick and inexpensive way to settle disputes. In general, the limit for each claim in California is $5,000, but this amount varies depending on the circumstances.

    Requirements

    You must be a mentally competent adult or emancipated minor to file a claim. "Mentally competent" means you have no mental disabilities.

    Monetary Limits

    Individuals can file a claim for up to $7,500. Corporations, partnerships, government entities and similar organizations are limited to $5,000 per claim.

    Additional Limits

    You can file no more than two claims per year for more than $2,500. You can file small claims for $2,500 or less as often as you want.

    Exceptions

    When you sue a guarantor, your claim is limited to $4,000 if you paid for the guarantee or $2,500 if you did not pay a charge. A "guarantor" is someone who has agreed to be responsible for an amount that you owe. An individual who files a claim against the Registrar of Contractors' State License Board is allowed to sue for up to $7,500.
