  • In California, there are two types of marriage licenses: public and confidential. They are similar in many respects but do have some varying requirements and applications.

    Confidential

    To use a confidential marriage license, the couple must be living together and the ceremony must take place in the county where the license is issued. No witnesses are required and the marriage record is only available to those named on the document.

    Public

    A public license allows a couple to be married anywhere in the State of California, but unlike a confidential license, at least one witness must be present at the ceremony and the marriage record is available to the public.

    Getting a License

    Confidential marriage licenses should be obtained through the county clerk's office in the county where the marriage will take place.

    Cost

    The cost of both a public and confidential marriage license in the state of California is the same. As of Dec. 2009, a marriage license costs $93.

    Requirements

    Unlike public licenses, no one under 18 can apply for a confidential license even with parental consent, and the couple must be living together. All other requirements are the same.
