this is deffinatly not fair, but unfortunatly this is how life works. half of the people in the world are below the average intelligance and they do stupid things. the motorist should have gotten off scott free but he was just unlucky. this reminds me of the case where a robber fell threw the victims roof and sued the victim for causing injury. he actualy won that

While unfair, the fine was legal. Pedestrians have the right of way. And, the fact that the driver slammed on his brakes and presumably slid may indicate that according to law the drive was going too fast for conditions. Driving is serious business and it's time people began treating it as such.

Stupid pedestrian of course it wasn't fair the motorist could do no more it, the pedestrian should have been careful, he shouldn't be talking on the phone whil crossing the streeet and he should have looked both ways.
