  • Deeds are legal documents used to transfer the ownership of real estate. A grant deed is used to transfer the property itself. A quitclaim deed is used to transfer a claim on the property.

    Deed Requirements

Every deed must include the name of the property's present owner, the name of the new owner and a description of the property. The person transferring property must sign the deed.

    Grant Deed

A grant deed makes an outright transfer of the property. It guarantees that the property belongs to the person making the transfer and spells out any limits on that person's ownership of the property.

    Quitclaim Deed

A quitclaim deed transfers only the present owner's existing interest or claim to the property. It is not required to identify how much of the property is owned and does not guarantee that the person making the transfer owns the property.

    Uses

Use a grant deed when you are certain that you have legal title to the property. Use a quitclaim deed when title to the property is unclear. Quitclaims are often used in marital settlements.
