Defense attorneys are assigned to or hired by the accused. They gather evidence, interview witnesses, research precedents and defend their clients in court. They counsel clients about their legal rights and obligations and suggest the course of action in the client's best interest.
Prosecution Verses Defense
In a criminal case, the government is represented by the prosecution and the person accused of the crime is represented by a defense attorney.
Fifth Amendment
According to the Fifth Amendment, all people accused of a crime must be provided legal representation. If they can't afford a defense attorney, the government assigns one to them.
Job
The defense attorney provides evidence for his client's innocence, attempts to cast doubt on the prosecutor's evidence, and may plea-bargain on behalf of her client to reduce or eliminate charges.
Education
A defense attorney must have a four-year degree from a recognized university, pass the LSAT and be accepted into a law school. They must then pass the bar exam for the state they wish to practice in.
Training
Defense attorneys go through the same schooling as any other lawyer in the United States. During undergraduate or graduate studies, they may choose specializations that would help them in the particular field they wish to enter such as criminal law, corporate law, civil law and so on.
