  • Sometimes called FMLA, the Family & Medical Leave Act is a law passed by Congress and signed by Bill Clinton in 1993. The purpose of the Family Medical Leave Act is to allow employees to have a balance between work and family life.

    Identification

    The Family & Medical Leave Act entitles some employees to a leave of absence following the birth of a baby or adoption of a child as well as for a serious illness that affects the employee or the employee's immediate family.

    Time Frame

    Employees are entitled to 12 weeks of family and medical leave once each calendar year.

    Features

    During family and medical leave, your employer is not required to pay you but must continue to pay its share of your health-insurance benefits. When you return to work, your employer must reinstate you to your previous position or a job with comparable pay and responsibilities.

    Requirements

    The Family & Medical Leave Act only applies to employers who have 50 employees within a 75-mile radius.

    Considerations

    Before you are approved for leave, your employer may require you to submit proof of the reason for your leave, such as a letter from a doctor or other professional. If you do not return to work after the conclusion of your leave, your employer has the right to request a portion or all of the premiums paid for your insurance during your absence.
