With all of the checks and balances and other limitations I would have to say, yes. I know that there are flaws, but aren't there flaws in every system?

Yes, for someone convicted by a jury of their peers of purposefully taking an innocent's life, they should be put to death.

Depends on the society. To us, stoning a whore would be murder, but back in New Testament times, inciting a mob was considered fair. So what do you have to do to be considered dangerous enough to be worth killing? How about genocide? Raping a two yr old? I think every person has a line that if someone crossed, they would pull the trigger.

Yes and no. In cases of murdering a husband who beats the crap out of you or hurts children it's not justified. In cases where they torture their victims or plan their crime it is justified. It really is an individual case by case basis.

    For some yes, others no.

I'm not crying over Ted Bundy getting what he truly deserved.

I think how it is applied could be examined though.

The American court systems can make tragic and irreversible mistakes. In the last 35 years in the U.S., over 130 people have been released from death row because they were exonerated by DNA and other evidence. These are all people who were found guilty "beyond a resonable doubt". Unfortunately, DNA evidence is not available in most homicide cases. As long as the death penalty is in place, it's pretty much guaranteed to occasionally exacute an innocent human being. That is enough reason to oppose it.

Even if an innocent man is murdered (example of a flaw) it's still just?

I don't know....Is murder just? Is it just that some innocent person dies at the hands of these people...but yet we should have sympathy for them?? YES! It''s just. Now...it just needs to be quick!
