I doubt you'll be able to find the owner of the debris that caused you to swerve in the first place. But if you can, you can bring a law suit against them. A funny thing about insurance companies. The driver who hits you in the rear is at fault. They rationalize this on the fact that, you could have stopped or you could have avoided it by going around.
