    They can't. Their job is to interpret it. Only Congress and the States can ammend the Constitution. Or the states can bypass Congress and demand a Constitutional Convention, as in 1789. Almost happened in the mid 1980s as the states were demanding a balanced federal budget. +5

    Supreme Court cannot change the Constitution of The United States. it was designed this way so that 2/3 rds ratification is necessary. this is one built-in protection our forefathers included in The Constitution, so that changes could not be made without the legislature facing a lot of opposition by the public.

    The constitution is written in the exact words you can read at http://www.usconstitution.net/const.html . The constitution can be changed only through amendments, which are proposed in the legislative branch and then must go through a lengthy process including ratification by the legislatures of 2/3 of the states. Basically, the courts cannot change what the constitution says.
    However, the courts can hijack the checks and balances by "legislating from the bench". In such cases, justices may have their own agenda by which they rule on cases that come before them according to their whims, with complete disregard to the constitution and with complete disregard to formulation of the law as done by the legislative and executive branches. They can do so because they, the justices of the courts, are the final arbiters of cases that come before them.

    because the fucking thing was written over 200 years ago and a lot has changed since then. It is about time they started. The constitution has to be amended. or it becomes fractionalized like the bible.
