I am 13 yrs old, and I was wondering if I am legally able to move in with my step-mom even though my father is in prison. I like my step-mom and I think she can take better care of me than my mother.

    Your step mom has no legal rights where you are concerned. If your mother agrees, she can give your step mom custody. You and your step mom can certainly call social services and investigate the possibilities. You and your step mom could also talk to an attorney about filing a petition with family court for a change in custody.

    Your best bet would be to make a plea to the judge. He/she will look at the whole situation and take it into account.
