    That depends on how severe the offense is. If the offender hasn't been put in jail for more than three months or fined more than $10,000, then the offense no longer "counts" after three years, if no other offenses have been committed in that time. More serious offenses remain on record, unless the offender manages to have them expunged. The process varies from state to state.

    In the Texas Courts system, misdeameanor records are kept 5 years just as criminal court records.
