Help answer this question below.

My son,was in a car accident in my car, while passing a slower car. Hit ice & wrecked. He is being tried for neg. driving. No one else involved, ni injuries except my car, airbags didn't deploy, No Officer present to witness, just the other driver.HELP!

    First, why was he passing anyone, if there was ice and snow on the pavement? this in itself could be considered reckless driving. the willful and wanton disrespect for the lives and property of others. passing on ice is reckless driving. the law states you shall have your vehicle under control at all times. apparently, you son did not and thus the accident.

    The officer may not have witnessed the accident, but he can issue a citation, based on extinuated circumstances and evidence at the scene.

    If what you have stated is true , in your question and comments, yes, your son should have been issued a citation for either neg. or reckless driving.

    Is he being tried or does he simply have to show up at a hearing for the ticket? Those are two exceptionally different things.

    Chances are, he was cited because there was no passing allowed, he was speeding or he was driving too fast for conditions. There's really not a lot you can do and if your son was actually in the wrong; you might be more concerned about him learning a lesson from this very lucky accident.

    If he was passing a car in icy conditions, it's fair for the officer to deduce, given the evidence available and the other driver's account, that negligent driving occurred. He could fight the ticket, but he'll have to explain why it was safe to pass in icy conditions, why he was speeding (possibly), why he was passing in a no passing zone (possibly) and why he thinks he was driving the same way any reasonably prudent driver would be. It's an uphill battle. Thank God everyone's okay and let you son be wiser for this experiece.

    if your son was passing to avoid a hazard by the way the other person was driving. I suggest you take it to trial and it will be dropped before it gets to trial.

    I dont entirely understand your question. How can he be charged with anything if no officers came to the scene? If police showed up after the accident, then I can only assume they found him at fault and charged him. Maybe want to call a lawyer and find out how to take care of this charge.
