Help answer this question below.

How do they prove careless driving? If the officer didnt witness the accident then who would be involved. what happened to inocent until proven guilty

    There are many examples of careless driving.

    Example: you are involved in an auto crash. the other driver tells the investigating officer that you were talking on your cellphone, ran the stop sign and caused the accident.

    There are two traffic violations here, one for running the stop sign and one for careless driving, which would be a contributing factor to both the stop sign violation and the accident.

    Careless driving is not difficult to prove, providing there is a witness or strong circumstantial evidence at the crash scene.

    Careless driving can and does get thrown out, but if there's evidence that indicates careless driving is the likely cause of an accident, then it's not really a case of innocent until proven guiltly.

    For instance, if traffic is proceeding normally and a car stops for a red light and is impacted by the car behind it, there's clear reason to suspect they were driving carelessly because in normal conditions a reasonably prudent driver would be able to come to a stop without running into another car (you could also write that ticket as following too closely).

    Or, if two cars are travelling side by side and there's a crash, it's because someone veered into the other's lane without properly seeing if it was clear. While this is failure to yield, it could also be written under the umbrella of careless driving. If not for a driver's careless actions, the accident wouldn't have occurred, so there is evidence of guilt.
