I am not sure, but as long as there was no convictions or protective order issued, I do not see the problem, unless it is all part of your permanent record?

On an application for nolle prosequi is not an adjudication on the merits of the prosecution, and so the charges may be brought again when more evidence has been collected. While he wasn't convicted of a crime, charges may still be pending until more sufficient evidence is collected for trial. If this doesn't apply to your situation then I see no reason why he would not be issued a permit unless he has a prior offense on his record that prohibits him from such permit.
