I have a signed divorce decree stating that my ex is solely responsible for a loan which I co-signed prior to divorcing. I am now being harassed by a collection agency since my ex has not paid. What can they do? Can they garnish my wages?

  • This is a tough one and there is no exact answer. You should check with the attorney that handled your divorce for specific legal help for your locality.

    Have you tried sending a copy of the divorce decree to the collection agency with a request that they cease harassing you with a duplicate to your ex and their attorney? If not, do so and do it by registered mail. That might be enough to get the collections agency off your back.

    Collection agencies can garnish wages. Generally, they try to garnish the wages of the person who took out the loan before going after a co-signer.

    This is tricky. I highly recommend you talk to an attorney.
