... then fine them or sue them for the entire costs incurred ... from the extra fuel used by their plane to the scrambled fighter pilots and their planes and everything else that was initiated as part of the "rescue or intercept" operation, to the value of the lost time for all of the passengers ...
... since it was not actually a serious criminal offense, no jail time ...
First degree stupidity comes to mind.
As it is, they're losing their jobs. Then they may lose their licenses. I don't know that any legal charges could/should be applied. Of course, I'm sure, also, that some lawyer will get at least one passenger to file a lawsuit for something, that will hit both the pilots and the airlines, though, how the airline is at fault is beyond me.
Negligence and endangerment.
Looking on the bright side, it would have been more catastrophic if they hadn't missed the airport, I guess...
