Let's put it this way. As an American citizen I defy the government from preventing me from marrying absolutely whomever I want. INS, neo-cons, KKK, the US Marines, the Girl Scouts -- NO ONE tells ME whom I can or can not marry.
Freedom to marry is not restricted by criminal convictions. There are death row inmates who married AFTER being convicted and incarcerated. So yes, you can still get married. Whether this will solve the implied dilemma of deportation is another matter.
It is perfectly legal to marry them - the question you are interested in is whether it would then be possible for them to immigrate and live in the US with you.
If an illegal immigrant is arrested and immigration is called, is there anyway to get the immigrant legal or get a visa?
