  • No problem. If people want to bring cases like these before the courts, let them. BUT, if they lose, allow the juries to consider whether the suit might actually be a case of fraud, extortion, or a malicious persecution of the party being sued. Make the plaintiff and their attorney(s) liable for the validity of their case, under penalty of fine or imprisonment. Watch the stupid cases slow down or, less likely, stop.
  • Loser pays all attorney fees on both sides. Companies will be less likely to settle if they know they are going to win and not be stuck with all the attorney fees.
