If prostitution is illegal, how can pornagraphy be legal?

    Pornography isn't illegal, because one of the actors is NOT paying the other actor to have sex with him or her.

    With prostitution, for example, a man might pay a woman $500 to have sex with her, and outside of 14 Nevada counties, that's illegal.

    But with pornography, the actors in the movie are being paid by someone who is NOT having sex with any of the actors in the movie, but is paying for "watching or taping privileges."

    That's the difference.

    The "watcher" is paying to WATCH or to VIDEOTAPE the people having sex, and NONE of the people having sex is paying any of the other actors to have sex with them.

    Paying to WATCH two or more people having sex, is still legal in many places.

    I think it totally is organized prostitution, or just as bad. Other than the screening for STD's I don't see how it's any better than prostitution. Porn is probably a government conspiracy to make money from prostitution. But they don't want us doing it under the table.

    It's a good question. If you f-ck a prostitute in a private hotel room, you're breaking the law. If you're holding a video camera, it's not only okay, but you can mass produce and distribute the evidence without legal consequences.

    So... the lesson is, get a video camera (and, perhaps, a business license to prove you're legit... but I doubt it's necessary).

    (Now to finally answer the question.) As I understand it, porn differs from prostitution legally on the basis of its artistic purpose. You're not paying the woman for sex, but for acting, modeling, and appearing in a movie. She's not having sex, after all--her character is.

    I'm not saying that makes sense, but it's my understanding that it answers the question in the legal sense. And, if you think about it, there's lots of stuff we can do/say on camera that we wouldn't get away with otherwise.

    Folks from my point of view, prostitution is trading sex or sexual favors for profit. The "acting" defense doesn't work, because the sex is real. On account of this principle any shows portraying violence to animals will display a disclaimer stating that no animals were actually harmed. In the case of porn actor really do get paid for having sex. This is not paid voyerksm either- the sex is choreographed.

    I think that this is a truly legitimate question.

    Prostitutes accept money in exchange for the performance of sexual services.

    Porn stars accept money in exchange for the videotaped performance of sexual services.

    In reference to the response [Anonymous on September 24th, 2009], it is not always true that the person paying for the porn stars is not involved in the sexual activity. Sometimes the person writing the checks is the one nailing the large-breasted, terrible actress. Also, if I purchase a prostitute for my friend that does not mean that he didn't commit a crime by fucking the prostitute. He can still be arrested for his activity.

    In my opinion, if you allow people to pay for porn, you should allow them to pay for sex. This service business should be regulated much like a restaurant or a tattoo parlor and the sex-servants should be licensed by the state.
