It can depend on where you live and what the laws are. An executor is supposed to "execute" the wishes of the deceased. If they do not they can be sued. If your name appears in the will you have a good chance of receiving what is yours but you will need to get a lawyer to fight them. In some states, it doesn't matter if your name is included if you are a blood relative. Certain blood relatives have a birth right to the estates of their family. Either way you need to speak to a lawyer to find out what your rights are and if you need to sue. For instance my sister died. My brother was executer and decided not to honor her wishes and keep everything for himself. I discovered he had her sign a new will without me in it. I sued and because it was my sister I was entitled to my share no matter what the executor thought. Good luck.

Are you named in the will? If you are, talk to the attorney handling the probate of the will.
