Yeah probably. My cousin's "baby-daddy" hasn't paid a penny of the child support thats been ordered and he still gets visitation rights.
-
Yes I think he will. Is he paying anything now? If he is not you can do something about it. But if it is a case where he is down on his luck but he is good to the child it would be good to keep him in your childs life as much as possible. Be glad he wants to be there. Some dads don't miss a payment but they never visit either and that is so hard on the child.

Do you have an attorney? have you ever had an attorney? are there court orders in place for the welfare of your child? If not, you are flirting with trouble. you may have never married this person, so, the court will make these decisions now and should have before now. Hire an attorney. do it for your child.

I was told that child support and visitation are 2 seperate issues. Whether the father pays his support, he gets to visit. I never really disagreed with that, because my children, or their support were not a tool to use against my ex husband. He is still paying child support and his youngest child turns 21 tomorrow, he will continue paying until he has paid back everything he is in arrears for. My kids went to stay with him in Florida every summer.

Usually visitation and child support are considered two separate issues by the courts in the US. Whether he is in arrears has nothing to do with the visitation schedule. If you think every weekend is too much, state your reasons clearly and rationally. Better yet, have an attorney do it for you. In addition, report the man to child support enforcement so you can garnish his wages for what is owed to you.

That are separate issues, and with some orders I've seen, that could only mean you didn't receive this month's payment. Also, in this economy, where 80% of all layoffs are men, it doesn't take much for him to get behind. It's interesting you put money over what's best for your child in the long term, beyond her growing years. I don't see how paying money should have anything to do with access to a parental relationship. It's your biological offspring, not a pinball machine that requires quarters... That's not to say that he shouldn't be responsible financially, or that it doesn't suck to feel like you're stuck doing it all yourself... but these are two unrelated things. The latter is an injustice to you, the former is an injustice to the kid and dad. Revenge on the other parent will only cause more stress for you because they will retaliate, then you, then them, etc. And the kid is stuck in the middle.

That's about one or two months of non-payment, providing he hasn't and the state simply has not forwarded it. Visitation is a separate issue and messing with it affects your child's overall future.
