Unless the law has been changed it is not illegal to tape (photograph) the person but without their written permission if you show it to anyone but him/her/them (recognizable in the photo or tape) it is illegal and you can be sued.

Yes, it's very illegal. You can have serious criminal charges brought against you and be sued in civil court as well. In many jurisdictions, you can be prosecuted for producing and distributing pornography. You may be charged with rape or sexual assault, too. Chances are high that you will be convicted and sentenced to at least some jail time. The worst thing is that your name will be listed for anyone to see on the sex offenders registry. You will be required to inform your employer and neighbors in writing about this, and will have to do so every time you change jobs or move to a new apartment. In the civil case, his lawyer is going to have no problem getting a huge settlement from you ($50,000 to $100,000), and perhaps more. It's just as illegal as a guy taping himself and a girl having sex without her knowing and then showing it to other people. My gf loves to film during sex. But that's cool because she has my permission, and she always asks before she shares the video with someone else. So if you're into film making, get your partner's permission, and you will have nothing to worry about.
