"The kids were in her care, but I returned them to him as he is refusing to provide financial support. Now the court is entertaining his claim against me." YOU returned the kids to him because he was refusing to provide child support??? Aside from the fact that YOU have no such power or standing in the court to do that, I question any part of this claim. Me thinks this was written by a disgruntled mother who may actually been ordered to pay child support, despite how rare that is. And, that you're refusing to work to avoid paying, so 20% of the income of your current S/O or husband has been included in the calculations. Though they can't attach his income directly, they can attach joint assets and checking.

They are not your children. If the children are with their father, the court will order support from the mother. If the children are with their mother, the court will order support from the father. This is NOT alimony. This is called child support.

Why on earth would you give him custody just because he refused to provide financial support???? I bet the kids feel really great about this.........

When you marry, you become legally responsible for the debts and other legal obligations of the spouse. The courts could, but probably won't, order you to pay her legal obligations. Child support cases are very difficult to judge. You say alimony, and I suspect that is not the correct term. Are you talking about child support? They are two entirely different things. If you do mean alimony, that is also called spousal support and has nothing what-so-ever to do with any children, her, theirs, or yours. It is entirely separate from child support, and refers only to a court order to pay support money to the ex-spouse.
