Senator Kennedy was not very active in the Senate in recent months due to his illness. I doubt that his death will have much effect upon the internal workings of the Senate. As for 'conservatives' being able to pass anything, even if you assume that every GOP senator is a conservative, and that all accused DINOs are as well... . http://en.wikipedia.org/wiki/Democrat_In_Name_Only#Accused_DINOs . ...that still only adds up to 44 votes. Other than legislation that benefits the Corporatist Kleptocrats who fund the campaigns on both sides of the aisle, I don't think you'll see any 'conservative' bills coming out of the Senate any time soon. . . .

The conservatives have two stones around their necks; One is President George Bush, who is still associated with the problems we just had. Most blame him and the conservatives for not enforcing the rules that let the financial meltdown happen. I mean if you can do stated income and stated assets to get a loan and they let you get away with it, why not lie about it as much as you can? The other is Rush Limbaugh. The more he opens his mouth, the worse the conservatives look since they believe his nonsense. Maybe they need to medicate him even more than he is..... So I think they need to get rid of those issues for the country to take them seriously again.
