In New Jersey, can you pass a police car on the right side if the police car is in left lane just moving along with traffic. You are in right lane with no traffic hoping to make a right hand turn soon.

    YOu should have fought the citation in court. paying the fine only added two marks to your drivers license and an increase in your auto insurance.

    I still believe you were correct. never heard of such a law.

    Passing on the right is illegal in most states. Some areas simply don't enforce it as much as others do.

    I recieved a similar ticket a few years ago. I retained a lwayer to fight the charge, citing my unfamiliarity with that law in my new state, and he told me this. You can probably still have the ticket dropped, just not on the basis of passing on the right being legal.

    Yes. if that lane is not occupied and you can make the lane change without violating a traffic law, it is ok to make the pass.

    Many people trail behind police cars and are afraid to pass, even if the officer is not going the speed limit. the officer does this for many reasons, one, that he may be asking for a registration on a vehicle in front of him and does not want to pass this vehicle, if the vehicle is discovered as stolen. there are many other reasons, also.

    If all drivers drove at the same exact speed limit of say 70 mph, traffic would come to a halt.

    Its about using your common sense, when driving.

    As long as the "right lane" you are travelling in is NOT the breakdown lane, and you are not speeding, I do not see a problem with it.

    It sounds rediculous but he can in fact cite you for that. I can't beleive he would, but there certainly are cops like that in NJ. I recently took a defensive driving course in which I learned that the orthodox rule of "don't pass on the right" even applies to flowing traffic. Unfortunately it is within legal limits for you to be ticketed, even though it seems like more work than it is worth to do that to you.
