Help answer this question below.

Ok if the law says your not an adult till your 18 then how are they getn away with throwing kids under 18 in prison or puting them away for life? theres a 16year old with the older men in prison as of today!

    You question contains a non sequitur. The legislature is free to construct any punishment it wants so long as it is not “cruel and unusual.” It is not cruel or unusual to sentence a person, child or adult, who commits a heinous crime to life in prison. Your question only makes logical sense if only adults can be sentenced to life in prison.

    It's called being tried as an adult. If your crimes were bad enough, and you show the mental attitude of an adult, you run the risk of being tried and sentenced as an adult.

    Ok, hypothetical situation:
    16 year old male robs liquor store with a handgun, killing the cashier. Hops into car driven by a 21 year old female accomplice that turns out to be his lover. at the trial, do they charge the woman with statutory rape while simultaneously charging the 16 year old as an adult?...

    I worked in a jail for kids. This one kid was sent there, 15, for assault and destruction of property. While in the kiddie jail, he took on one of the guards. This occurred in a matter of minutes. The guard was lying on the floor, bleeding, head bashed in, and before the other guards could arrive, the kid kept kicking this guard in the face, and stamping on his hands after the guard was unconscious. It was on videotape. The kid was taken before a judge who decided he should be tried as an adult. The guard still requires medical treatment for his eyes, teeth, internal injuries and smashed bones in his hands. This 'kid' could take on anyone. +4

    Good question. I mean at what point is someone considered an exception to the rule? A 16 year old shouldn't be housed with adults they're not even in the same weight class?

    I think decreasing recidivism should be a goal as well.

    About 16 year old with seasoned criminals, remember that all prisons are a form of public housing.

    You said; "they get away with throwing kids under 18 in prison", well (1st) first of all its not "THEY" its "we." We make, use, and change laws.
    (2nd) Its well documented that adolescents are maturing and becoming more sophisticated at an earlier calender age.
    (3ed) Perhaps there is a lack o socialization with regard to adolescent self-control and regard for others, choosing the weakest of those around them as legitimate prey. e.g.(elderly, the invalid, weak or young)

    In conclusion; there are 3 reasons that a society imprisons someone.
    i.) Rehabilitation;
    ii.) Remove and isolate from normal societal interaction.
    iii.) Retribution.

    A person, independent of age of maturity, can be so asocial in their makeup that they cannot take a fit place in society and must be isolated from it.

    {B.N. early prisons were called "penitentiaries" because the it was thought that the time a prisoner spent away from society would be used in penitence and seeking forgiveness (presumably of god). }
    (B.N. 2 The reason that we own and use a legal system is to remove the "instant revenge" feelings of the victim. The pretrial effort is deliberative, and may evaluate the felony as raising to the level of being tried in a higher court.)

    The nature of his crime and the manner in which he comitted it led the court to treat him as if he were an adult; with all the "rewards" that go with that.

    Each person is responsible for their actions. Adult or juvenile. There are courts that deal with Juvenile and prisons for Juveniles. Young Offenders Institutions as they are called. Children under the age of 10 have a different sort of courts that they are "tried" in or listened to. Every crime needs to be addressed. Children and youngsters are not put in the same prison or cell.

    Because the primary purpose of prison is protecting the public from criminals, regardless of their age. I support giving kids second chances as long as the crimes are not extremely violent, but in cases like murder and rape, they should be sentenced to life without parole.
