Help answer this question below.

Dad was sentenced a week ago to 2 1/2 years in prison (assault) for pouring hot grease over a colleague's face, causing him second degree burns (he is a chef) in Toronto. He will be sent to a federal prison, too harsh? Should we sue the federal gov.?

    Two problems: First, the federal government did nothing wrong, so you have no basis for suit. Second, you cannot sue the federal government (or any government) simply because you do no like the sentence they provid.

    What would be the basis of your suit? If your Dad actually did the deed and was convicted in court, it sounds like the government followed the rules. If you want to sue to try to get a less harsh sentence, you'll have to ask a lawyer if that's even possible. You should be able to ask that question over the phone for little or no legal fee.

    For what would you sue? The courts, while appointed by the government, are independent. Which government (not court) official was delinquent in their duty? If you consider the sentence too harsh (which it does not, prima facie, appear to me), the mechanism is an appeal against sentence, not the civil course of sueing.

    First you might try bobbing for French fries, then decide if the penalty was too harsh. Toronto is in Canada--do you also speak of your central government as federal in Canada?

    Yep, in this sue-happy/blamism society of ours, he should go ahead and sue. It's ALWAYS someone else's fault when a crime is committed, it's never the perpetrator's fault. Furthermore, perpetrators should NEVER be held accountable for their actions. So go ahead and tie up the already over-burdened court system with yet another frivolous, meritless lawsuit, and by some amazing stroke of luck, the moon & stars may line up properly for the side of evil and the suit prevails. Taxpayers don't mind working just a little but harder and a little bit more to fund such activities, the most important thing is that dear ol' dad gets a pat on the back for his "filet-of-face" episode. After all, he's probably just misunderstood, or maybe he wasn't properly breast-fed as an infant, but a negative consequence to his negative behavior? NEVER!!

    Let me ask you this, dear reader: if/when YOU become the victim of a crime, do you think your opinion of fairness would display the same benevolence toward YOUR perpetrator as you think your pops should receive?

    The sentence is the sentence. No offense, but if he caused another person second degree burns to their face, you don't think that deserves time? Do you also realize that your Dad will get a mandatory release 2/3 the way through, meaning a chance to go on the street? So, he does 20 months then gets a chance back on the street. If he follows the rules, he won't have to finish his sentence in jail. Also, IF he is a first time federal offender, he may be able to get released at half point if he is on good behavior. Time in Canada is not always what you think.
