If the roles were reversed, I would say no. They would just put the child in foster care and order the father to pay for it, but in your case, there's a good chance simply because you're the mother, even if the allegations were false.

First, what is the reason why you don't have them? Then, if you have joint custody, you're half responsible for their situation. They may come after you as well. I know it doesn't make sense & it's not fair but that's government beureacracy for you. Good luck!

You're reading My husband has temporary custody of my 3 kids. His house is filthy and unhealthy. My kids are unsupervised and are living in an unstable atmosphere. Will DCFS remove them from his home and give me custody if I report this?

It really all depends on why he has custody and you do not. The last thing you want to do is get DFACS involved...they are no fun. They dont always do the best thing. But even if you call them...it really depends on how filthy and unhealthy...but they will probably tell him to clean it up and come back and check it out and that could be it. But then again ...they could take them. But once they get invloved....they will start looking at his back ground and all kinds of things that is not even related to the call. If they take them...I would think the next in line would be you.....but that depends on why you dont have them now. Try calling the police over there. I had a neighbor once thats was fighting and the police were called and they seen the house and ask them to clean it or they were calling DFACS. Have you talked to him about it(the dad)? If your doing this just to get your kids back it probably wont work.
